To ensure the involvement of both parents in the care of the child, fathers of newborns are entitled to 14 calendar days of paternity leave, granted in accordance with Article 124¹ of the Labor Code of the Republic of Moldova.
The leave can be requested in full, within a maximum of 12 months from the child’s birth, based on a written request addressed to the employer. A copy of the child's birth certificate must be attached to the request.
During the paternity leave, the employee receives paternity benefits, amounting to 100% of the average monthly insured income earned in the last 3 calendar months prior to the month of the child’s birth, income from which contributions were calculated and paid at the time the benefit was granted.
The right to paternity benefits is established if the father of the newborn child confirms a total contribution period of up to 3 years or a contribution period of at least 9 months in the last 24 months preceding the child's birth and meets the following conditions:
– He has been granted paternity leave at all workplaces where he is employed, within 12 months from the child’s birth;
– He has requested the paternity benefit within 12 months from the child’s birth;
– He has earned insured income in the last 3 months prior to the child’s birth.
The application for paternity benefits is submitted in person by the father or mother of the child, along with supporting documents, to the territorial social insurance office at the place of domicile/residence or to the office serving the primary workplace. The application can also be submitted electronically via the government's unified public services portal (https://servicii.gov.md/ecnas) or on the official website of the National Social Insurance House (cnas.gov.md).
Together with the application, the following documents are required:
– The applicant’s ID card (original and copy);
– The child’s birth certificate, registered with the Public Services Agency (original and copy);
– If applicable, the extract from the order granting paternity leave, in original, issued by all workplaces where the applicant is employed.
The application is reviewed within 30 calendar days. The applicant can check the status of the request online at: https://servicii.gov.md/ecnas/Status/Info or by calling the CNAS Call Center at 022 257 777.
The payment of paternity benefits is made from the state social insurance budget, through the payment method selected by the beneficiary: either by card or at the post office.
**NOTE!**
Starting January 1, 2024, paternity leave will be increased to 15 calendar days and can be granted either in full or divided into a maximum of 3 fractions of 5 days each.
Additionally, this type of leave will also be available to socially insured fathers who have adopted a newborn child.
